Background

As drafting of the EU AI Act reached its conclusion in 2023, an eleventh hour attempt emerged to exempt the most powerful AI models from the Act’s regulations. 

Foundation models are general-purpose AI models that have capabilities and powers which their developers cannot predict.

Exempting foundation models from the EU AI Act would have left the most powerful and dangerous AI unregulated.

Moreover, it would have placed an enormous regulatory burden on small businesses and startups who build their applications from foundation models, leaving them entirely liable for any harms caused by the foundation models they used.

Outcomes

We campaigned to ensure that the EU AI Act didn’t leave the most powerful AI unregulated, and in December 2023 the European Parliament settled on an EU AI Act that didn’t just include foundation models, but placed special regulations upon foundation models that have been trained with computational resources beyond a certain threshold.
